When to choose SEZ land — and when not to

Special Economic Zone plots suit operators whose demand is export-facing: duty-free plant, zero-rated inbound supplies and a single-window route through the Development Commissioner.

Why teams choose SEZ land

  • Duty-free capital equipment

IT plant, electrical equipment and cooling gear can be imported without customs duty against your letter of approval — material on a hardware-heavy build.

  • Single-window approvals

The Development Commissioner's office and the Approval Committee handle unit approvals, which shortens the chain of agencies you deal with.

  • Zero-rated inbound supplies

Supplies into an SEZ unit are treated as zero-rated under GST, which improves the working-capital profile during fit-out.

  • Zone infrastructure in place

Notified zones are developed with internal roads, a power ring, water and multiple carrier ducts before plots are leased.

  • Bonded, access-controlled estate

A customs-bonded, gated zone with its own perimeter suits operators whose customers ask for a hardened physical boundary.

What to check before you sign

  • Net foreign exchange obligation

An SEZ unit must be net foreign exchange positive across the prescribed block and file periodic performance returns.

  • Domestic sales are a procedure

Serving the domestic tariff area from an SEZ unit is possible but duty-bearing and procedural, not a free flow. Mostly-domestic demand usually belongs elsewhere.

  • Customs-bonded operations

Hardware movement, spares, repairs and scrapping all follow customs procedure. Operations teams need to be set up for it.

  • Tax holiday has sunset

The income-tax holiday for new SEZ units has lapsed. The live case is indirect-tax and procedural, so model it on that basis rather than on legacy incentives.

  • Exit and de-notification

Converting a unit or part of a zone to serve domestic demand requires approvals. Build that optionality into the lease rather than assuming it.

Process

Getting SEZ land data-centre ready

Six stages, run in parallel wherever the approvals allow it. You get a written position on power and title before any money is committed.

  1. 01

    Zone and unit fit

We shortlist notified zones whose sectoral approval, infrastructure and vacancy suit a data-centre or IT/ITeS unit.

  2. 02

    Letter of approval

The application to the Development Commissioner and Approval Committee sets out activity, investment and net foreign exchange projections.

  3. 03

    Plot lease from the developer

Lease term, built-up options, zone charges, expansion rights and exit provisions are negotiated with the SEZ developer.

  4. 04

    Customs bonding

The bond-cum-legal undertaking and warehousing approvals let you import IT and electrical plant duty-free against the letter of approval.

  5. 05

    Zone approvals and build

Building-plan sanction from the zone authority, fire NOC and pollution-board consents, then the shell and power yard.

  6. 06

    Compliance setup

Performance reporting, NFE tracking and the domestic-sale procedure are in place before the first rack is energised.

Rule of thumb: the checklist opposite is what moves SEZ land from an interesting parcel to a buildable site. We map the owner, fee and realistic duration of each item before you sign.

Compliance

Approvals and documents for SEZ land

Exact names and sequencing differ by state and local authority. This is the checklist we work through, and the one your lender will expect to see closed out.

  • Letter of approval from the Development Commissioner / Approval Committee
  • Lease deed with the SEZ developer, tied to the LOA
  • Bond-cum-legal undertaking with customs
  • Private bonded warehousing approval for imported plant
  • Building-plan sanction from the zone authority
  • Fire NOC and state pollution control board consents
  • Power connection agreement within the zone
  • NFE tracking and periodic performance reporting setup

SEZ Land: frequently asked questions

The live benefits are mainly indirect: duty-free import of IT and electrical equipment against your letter of approval, zero-rated supplies into the zone, developed zone infrastructure and a single-window process through the Development Commissioner. The earlier income-tax holiday for new units has sunset, so the case today is duty-based and procedural rather than a tax holiday.
